PERFORMANCE CONTRACT BETWEEN THE GOVERNMENT OF KENYA THROUGH

THE MINISTRY OF LOCAL GOVERNMENT AND THE MUNICIPAL COUNCIL OF ELDORET

FOR THE PERIOD 1ST JULY 2008 TO 30TH JUNE 2009

PERFORMANCE CONTRACT

This performance contract (herein after referred to as the “contract”) is entered into between the (Government of the Republic of Kenya through it’s Ministry of Local Government (hereinafter referred to as “GOK” )of P.O Box 30004 – 00100, Nairobi (together with its assignees and successors)on the one part, and the Municipal Council of Eldoret of P.O Box 40 – 30100, Eldoret on the other part.

WHEREAS
The Government is committed to ensuring the Local Authorities are well managed and cost less in delivering efficient and quality service to the public.

The Government recognizes that Local Authorities hold vital key to improving performance and restoring the faith of the Kenyan people in the Government;

The parties recognize the need for adequate and reasonable managerial and operational autonomy to facilitate achievement and management of Municipal Council of Eldoret of the agreed and freely negotiated performance targets set out in this contract.

The council has indicated its capacity and competence to perform the duties and undertake the functions specified therein.
This contract represents a basis for continuous improvement of the Local Authority to meet the needs and expectations of the Kenyan people.

From this contract, should flow the program and management priorities of the Municipal Council of Eldoret.


NOW THEREFORE, the parties hereto agree as follow:


PART I

Vision

To become a reputable Council in effective and efficient delivery of services.

Mission

To ensure that council services are responsive to the needs and aspirations of the people of Eldoret through participatory planning and sustainable use of resources.

Objectives

(i) Enhance resource mobilization.
(ii) Provide democratic and accountable government for local communities.
(iii) Provide services to communities in a sustainable manner.
(iv) Provide safe and healthy environment.
(v) Encourage involvement of communities and community organizations in matters of the municipal council.
(vi) Provide conducive environment for investment opportunities, creation of employment and alleviation of poverty.
(vii) Provide and maintain the infrastructure.



PART II

Commitments and Responsibilities

The Municipal Council of Eldoret hereby commits itself to: -

a) Implementing the Strategic Plan and ensuring that it is linked to national policy documents such as National Development Plan, and Vision 2030 etc.

b) Designing appropriate annual work plans.

c) Developing Comprehensive performance targets.

d) Assigning weights to performance indicators.

e) Signing performance contract with the Permanent Secretary, Ministry of Local Government;

f) Ensuring the achievement of the agreed performance targets and

g) Preparing employees of the council for the desired changes in working styles, attitudes and work ethics.

PART III

Commitments and Obligations of the Government.

In signing the contract, we would like the Government, through the Ministry of Local Government to facilitate the implementation of our programs/projects by committing itself to the following;

a) The Government of Kenya to ensure timely disbursement of LATF, CILOR, RMLF and other allocated funds within the stipulated statutory period as per existing guidelines

b) The Government of Kenya shall grant approvals of requests from the Council within 21 working days.

c) The Government of Kenya shall respond to all correspondences from the Council within 7 working days after receipt.

d) Ensure prompt Council’s budget approval in accordance with the Local Government Act Cap. 265 and Ministry of Local Government Budget guidelines.


PART IV

Frequency of monitoring and information flow.

The Municipal Council of Eldoret hereby undertakes to submit quarterly and annual performance reports in the prescribed format in conformity with the performance contract guidelines.



PART V

Duration of the Performance Contract

The performance contract will run for a period of twelve (12) months commencing 1st July 2008 and ending 30th June 2009.
